Principles

Your right to privacy is important to us. Please read our Privacy Statement below to understand what data we will collect and process about you.  Under this Privacy Policy, "we" refers to Talk-Be who acts as a Data Controller and Data Processor.

Information that we may collect from you

  • Information that you provide by filling in forms on our site. This includes personal identification information provided at the time of contacting us via our online form, email, text or WhatsApp.
  • If you contact us, we may keep a record of that correspondence.
  • We may also ask you to complete voluntary surveys that we use for research purposes. 
  • Details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data.

Cookies

Our site uses cookies to distinguish you from other users of our website. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site. We offer the opportunity to decline cookies.

Where we store your data

  • We work with secure cloud storage facilities which are located in the United Kingdom.  
  • Written or printed data which contains personal information is securely stored in locked premises in the UK. 
  • By providing us with your personal information, you consent to allowing us to store your data in this way

Under UK GDPR legislation, the lawful basis on which we rely on to process your data are:

What we use your data for

We use your personal data for the purposes of:

  • Correspondence with you
  • Billing
  • To carry out obligations under the contract that you enter into with us
  • Working with you as part of your mediation
  • To ensure that you receive the best service from our site
  • To request feedback about the service that you have received
  • To update you with any change in our circumstances that may affect you
  • To communicate with you where there is legitimate business interest
  • To provide relevant information or marketing of services where you have given us consent to do so.

Retention and disposal of your data

We will retain and use data about you that you provide to use for the purpose of conducting mediation services. 


Mediation is confidential and without prejudice.  At the end of the mediation session, all notes, data and information is destroyed (shredded) as quickly as is reasonably possible.  This includes information that you have sent to us electronically.  We will permanently delete that from our IT equipment and any cloud storage services.  


We will retain the Agreement to Mediate which you signed prior to the mediation session for a period of 7 years.


We may retain personal information limited to your name, organisation (if relevant), telephone number, email address and postal address for the purpose of marketing if you have consented to us doing this.

Disclosure to Third Parties

We will not disclose personal or confidential information to a third party without your consent to do so.  There are some exceptions to this where your personal data may be disclosed:


  • Where we are under a duty to do so because of a legal obligation and there is a proper reason for doing so
  • In order to enforce our terms of business, protect our rights, property, safety or those of our customers or others



Access to your data

Under UK Data protection you have the following rights:


  • Your right of access - You have the right to ask us for copies of your personal information. 
  • Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 
  • Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 
  • Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances. 
  • Your right to object to processing - You have the the right to object to the processing of your personal data in certain circumstances.
  • Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.


You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

How to Complain

In the first instance, please contact us in order to exercise your rights as detailed above.  


You can also complain to the ICO if you are unhappy with how we have used your data.
